Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of Eazyads, an AI-powered product advertisement generation service (“Service”). By using Eazyads, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of any changes.

Service Description

Eazyads is an AI-powered platform that creates professional advertisement images and videos from product photos OR text descriptions. The Service includes:

• Text-to-image and text-to-video generation capabilities
• Multiple AI models for image and video generation
• 130+ filters (27+ product image, 25+ UGC image, 25+ product video, 25+ UGC video, 30+ VFX video)
• Custom “Your Vibe” transformation prompts
• 9 aspect ratios for images, portrait and landscape for videos
• History management and sharing features

Eligibility

You must be at least 18 years old to use Eazyads. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account and Subscription

Account Creation

To access paid features, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Subscription Plans

We offer three subscription tiers with monthly credits:

• Essential: 30 image credits + 20 video credits per month ($29/month)
• Growth: 125 image credits + 75 video credits per month ($99/month)
• Scale: 400 image credits + 180 video credits per month ($249/month)

All plans include access to multiple AI models, text-to-image and text-to-video features, and all 130+ filters. Plans are billed monthly. You can upgrade, downgrade, or cancel at any time.

Credits and Usage

• Monthly credits reset on your billing date
• Image generation costs 1-2 credits per generation depending on the selected AI model
• Video generation costs 1-6 credits per generation depending on the selected AI model
• Credits can be used with any AI model or filter available in your plan
• Unused credits do not roll over to the next month
• If you exceed your credits, you must upgrade or wait for the next billing cycle
• Downgrades take effect at the next billing cycle

Billing and Payment

Payment Terms

• Subscriptions are billed in advance on a recurring basis
• You authorize us to charge your payment method automatically
• Prices are subject to change with 30 days' notice
• All fees are non-refundable except as stated in our refund policy

Refund Policy

We offer a 14-day money-back guarantee on all new subscriptions. If you're not satisfied within the first 14 days, contact us for a full refund.

If you cancel mid-billing cycle, you will receive a prorated refund for any unused credits. For example, if you used 20 out of 50 image credits and cancel, you'll be refunded for the 30 unused credits.

Cancellation

• You may cancel your subscription at any time
• No long-term contracts or cancellation fees
• Access continues until the end of your current billing period
• Prorated refunds are issued for unused credits

Usage Rights and Restrictions

Your Rights

• You retain ownership of your original product photos and text prompts
• You own all AI-generated images and videos created through Eazyads (whether from photos or text)
• You may use generated content for any commercial purpose, including ads, social media, e-commerce, and marketing
• You may download and share generated content freely

Acceptable Use

You agree NOT to:

• Upload illegal, harmful, or offensive content (images or text prompts)
• Violate intellectual property rights of others
• Attempt to reverse engineer or exploit the Service
• Use automated tools to scrape or abuse the Service
• Share your account credentials with others
• Circumvent rate limits, usage credits, or model access restrictions
• Upload content depicting minors without proper consent
• Use the Service to generate misleading or deceptive content

Content Responsibility

You are solely responsible for:

• The content you upload to Eazyads (images and text prompts)
• Ensuring you have the rights to use uploaded images or text descriptions
• Compliance with applicable laws and regulations
• How you use AI-generated content in your marketing
• Any claims arising from your use of generated content

We reserve the right to remove content or suspend accounts that violate these Terms or applicable laws.

AI-Generated Content Disclaimer

Eazyads uses multiple AI models to generate content from photos and text. Please note:

• AI outputs are not always predictable or perfect
• Different AI models may produce different results and quality levels
• Generated content may occasionally contain artifacts or inaccuracies
• We do not guarantee specific results or quality from any AI model
• You should review all generated content before commercial use
• We are not liable for how you use AI-generated content

Service Availability

We strive to maintain high availability but cannot guarantee uninterrupted service. We reserve the right to:

• Modify or discontinue features with notice
• Perform maintenance and updates as needed
• Limit or suspend access for security or abuse reasons
• Change pricing with 30 days' notice to existing subscribers

We are not liable for any downtime, service interruptions, or data loss.

Intellectual Property

Eazyads and its technology, design, branding, and code are owned by us and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our software
• Use our branding without permission
• Reverse engineer our technology
• Create derivative works of the Service

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE LAST 12 MONTHS
• WE ARE NOT LIABLE FOR THIRD-PARTY SERVICES (Kie.ai, payment processors, etc.)

Indemnification

You agree to indemnify and hold harmless Eazyads from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

Dispute Resolution

If you have a dispute with Eazyads:

1. Contact us at hi@eazyads.app to resolve informally
2. If unresolved, disputes will be settled through binding arbitration
3. You waive the right to participate in class action lawsuits

Termination

We may suspend or terminate your access to Eazyads at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service
• Non-payment

Upon termination, you lose access to the Service and any data stored on our servers. You may download your content before termination.

Governing Law

These Terms are governed by the laws of the jurisdiction where Eazyads is registered, without regard to conflict of law principles.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance. If you disagree with updated Terms, you may cancel your subscription.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
